Privacy policy
Erfkern is a sole trader software studio based in Hamilton, New Zealand (NZBN 9429053534934). This policy covers erfkern.com and, unless an individual app states otherwise on its own domain, the apps built by Erfkern.
What we collect
At the studio level, we collect what you'd expect from a small business: your name and email address if you contact us through a form or send us an email, and whatever you write in that message. We don't run analytics or tracking scripts on this site, so no browsing data is collected here beyond standard server logs (IP address, page requested, timestamp), kept briefly and only for security purposes.
Each app built by Erfkern collects more than this, depending on what it does, and documents its own data handling on its own page. For example, If I'm Away states plainly what it never stores and how quickly generated files are deleted, on its own privacy notice rather than here.
Where your data is stored
Erfkern's infrastructure runs on a server located in Nuremberg, Germany. Where an app uses AI processing, requests are sent to Mistral AI, based in France. No data is stored on servers outside the European Union as part of Erfkern's core infrastructure.
Who we share data with
We work with a small number of processors to run the studio and the apps: Stripe for payments (EU entity), Brevo for transactional email such as receipts and confirmations (based in France), and Mistral AI for apps that use AI processing (also based in France). None of these are advertising networks or data brokers, and none of them use your data for anything beyond the specific job we've hired them to do. We don't sell data, full stop.
Your rights
Under GDPR you can ask to see what personal data we hold about you, ask us to correct it, or ask us to delete it. Email privacy@erfkern.com and we'll get back to you within 30 days.
For apps that delete what they generate automatically, like If I'm Away removing its generated PDFs within 7 days, a deletion request often arrives after the file is already gone. We'd rather say that plainly than let you think there's a request to make when there usually isn't.

Terms of service
Using our apps
You need to be 18 or older to use an Erfkern app, or have a parent or guardian's permission if you're younger. Use the apps for what they're built for, don't try to break or abuse them, and don't resell or share your access with anyone who hasn't paid for it themselves.
Payments and refunds
Refunds are given for genuine technical failures, not change of mind, in line with how the NZ Consumer Guarantees Act treats digital goods once delivered. If something you paid for didn't work as described, tell us and we'll sort it out.
Exact refund mechanics, such as If I'm Away's automatic refund if report generation fails twice in a row, are specific to that app and documented on its own terms page rather than here.
Liability
Erfkern apps are provided as-is. We do our best to keep them accurate and working, but to the extent the law allows, we're not liable for indirect or consequential loss arising from using them.
Where an app gives you information, such as If I'm Away's resilience report, that information is general in nature. It isn't legal, financial, or medical advice, and it isn't a substitute for advice from a qualified professional.
Changes to these terms
If we make material changes to these terms, we'll update the date at the top of this page. For anything significant, we'll also email people with an active account or a recent purchase, where we have an address to reach them at.
